Terms of Use

1What this service is — and is not

Viwaham.com provides a platform where individuals and their families can publish matrimonial profiles, search for profiles, and express interest in one another with a view to marriage.

2Eligibility

To register you must:

• be at least 18 years of age, which is the minimum legal age of marriage in Sri Lanka;
• be legally free to marry under the law of your country of residence — you must not be a party to a subsisting marriage;
• register either for yourself, or for a relative with that person's consent;
• provide and confirm at least one contact channel — a mobile number or an email address — and keep it current;
• not be a person barred from using the service under any applicable law, or previously removed by us.

We may ask for proof of age or identity at any time and may suspend a profile until it is provided.

3Your account

You are responsible for the security of your account, including any one-time passcode sent to your registered mobile number or email address. Do not share access. Tell us immediately at support@viwaham.com if you believe your account has been used without your authority. You are responsible for activity carried out through your account.

You must provide accurate information and keep it current. Publishing false information about age, marital status, education, occupation or income is a material breach of these terms.

4Duration of membership

Your membership continues for as long as you use the service, or for the term of any paid plan you have purchased. You may close your account at any time by contacting us. We may suspend or terminate an account in accordance with section 15.

5Member content

• You are solely responsible for the text, photographs and other material you publish.
• You must own the material you upload or have the right to use it. Do not upload another person's photograph without their permission.
• You grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and distribute that material for the purpose of operating and promoting the service. This licence ends when the content is removed, except for copies retained in backups or where retention is required by law.
• We may review, edit, refuse or remove any content at our discretion, including content that is misleading, unlawful, offensive or contrary to these terms. We are not obliged to monitor content.
• Profile pages are publicly accessible and may be indexed by search engines. Do not publish contact details, financial information or anything else you would not want seen publicly.

6Prohibited conduct

You must not:

• impersonate anyone, or create a profile for a person who has not consented;
• use the service for anything other than seeking marriage — it is not a dating, casual-relationship or escort service;
• solicit money, gifts, investments, loans or financial assistance from another member, or promote any commercial scheme;
• harass, threaten, abuse, stalk or defame another member;
• post obscene, pornographic, hateful, discriminatory or unlawful material;
• contact any member under 18, or seek to;
• collect, scrape, copy or store member data by automated means, or reproduce our profile database in whole or in part;
• send spam or bulk unsolicited messages;
• attempt to gain unauthorised access to the site, introduce malicious code, or interfere with its operation;
• use the service to recruit members to a competing platform.

We report suspected criminal conduct to the relevant authorities.

7Interactions between members

You are responsible for your own dealings with other members. We do not verify the accuracy of profile information beyond the checks described on our About page, we do not conduct background or criminal-record checks, and we are not a party to any arrangement between members or their families.

8Payments, renewals and refunds

• Registration and browsing are free. Certain features may require a paid membership; the price and term are shown before you pay.
• Fees are stated inclusive of applicable taxes unless indicated otherwise, and are payable in advance.
• You may cancel a paid plan at any time; cancellation stops future billing and takes effect at the end of the current term.
• Because access is granted immediately, paid memberships are generally non-refundable once the term has begun. We will consider a refund where the service was not delivered, where you were charged in error, or where a refund is required by applicable consumer law. Requests should be sent to support@viwaham.com within 14 days of the charge.
• No refund is due where an account is terminated for breach of these terms.

9Privacy

How we handle your personal information, including our use of cookies and third-party advertising, is set out in our Privacy Policy. We do not disclose member contact details to other members, and we do not sell personal information.

10Intellectual property

The Viwaham name and logo, the site design, its text, graphics and software are owned by us or our licensors and are protected by copyright and trade mark law. You may not copy, reproduce or create derivative works from them without our written permission. Content you publish remains yours, subject to the licence in section 5.

11Advertising and third-party links

This site displays advertising supplied by third parties, including Google. Advertisements and links to external sites are not endorsements. We do not control third-party sites and are not responsible for their content, products or privacy practices. Your dealings with an advertiser are between you and them.

12No guarantee of outcome

We do not promise that you will find a partner, that you will receive any particular number of responses, that any profile is genuine or accurate, or that the service will be uninterrupted or error-free. The service is provided on an "as is" and "as available" basis, and all warranties not expressly given here are excluded to the fullest extent permitted by law.

13Limitation of liability

To the fullest extent permitted by law, Viwaham.com and its officers, employees and agents are not liable for: the conduct of any member, whether online or offline; the accuracy of any profile; loss or damage arising from a relationship or marriage entered into through the service; indirect, incidental or consequential loss; or loss of data or profit.

Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you have paid us in the twelve months preceding the claim, or LKR 5,000, whichever is greater. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

14Indemnity

You agree to indemnify and hold harmless Viwaham.com, its officers, employees and agents against any claim, damage, loss or expense (including reasonable legal costs) arising from your use of the service, your content, or your breach of these terms or of any law.

15Suspension and termination

We may suspend or terminate your account, with notice where practicable, if you breach these terms, if your profile appears to be fraudulent or duplicated, if we are required to do so by law, or if your conduct puts other members at risk. Where the breach is serious — fraud, solicitation of money, contact with a minor, or abuse — we may act immediately and without notice.

You may close your account at any time by writing to us. Sections 10, 13, 14 and 16 survive termination.

16Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of the Democratic Socialist Republic of Sri Lanka. The courts of Colombo have exclusive jurisdiction, save that nothing prevents a consumer from bringing proceedings in the courts of their country of residence where applicable law gives them that right.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

17Changes to these terms

We may amend these terms. The revision date appears at the top of this page, and we will notify registered members of material changes by email or by notice on the site. Continuing to use the service after a change takes effect means you accept the revised terms.
